TERMS: Terms are offered to those with established credit. All accounts due net 30 days. If account is turned over to attorney for collection, buyer pays attorney fees. All other accounts are cash on delivery.
TRUCK DELIVERY: We can make truck delivery on full loads or pool your order with other customers in your area to make a load at rates as low as possible. Common carrier is not an option. If no instructions are given, we will forward to the best of our judgment without assuming responsibility. All shipments travel at the purchaser’s risk and expense.
YOUR TRUCK: If you prefer to call for your own stock, we should have advance notice. Your order will be pulled and ready to load when you arrive. Orders may be picked up Monday through Friday between the hours of 8:00 am- 11:30 am and 1:00 pm- 4:30 pm.
CAUTION: We accept all orders subject to crop conditions and a condition that same will be void should injury befall our stock from hail, fire, frost, error in count, or other causes beyond our control. All orders are accepted without liability for non-performance if labor shortage or delay in transportation should prevent us from making delivery.
CLAIMS: Claims for any cause must be made promptly in writing upon receipt of stock. We will not entertain claims made after goods have once been accepted or when report is not made in writing within 10 days after arrival of stock. In any case, no claim will be considered regarding orders, which have not been paid for, in full accordance with our regular terms of 30 days from date of invoice.
PRICES: Prices quoted herein are f.o.b. Monticello Florida. Prices named in the list are based on present market conditions and are subject to change without notice. These are wholesale prices and apply to wholesale quantities. We make every effort to limit the distribution of trade prices to those whom we know are entitled to receive them.
GRADING: All Simpson stock is graded generously with American Nursery & Landscape Association standards used as a minimum.
GUARANTEE: If any nursery stock proves untrue to the description or variety name under which it was sold, we hold ourselves in readiness, on proper proof, to replace such nursery stock or refund the original amount paid. We neither express nor imply any warranty as to the productiveness or life of the nursery stock we sell and will not be in any way responsible for the results secured in transplanting. We shall in no case be liable for any sum greater than the amount originally received for said nursery stock.
The parties hereto agree that any dispute arising out of the sale of these goods shall be arbitrated exclusively in the 2nd Judicial Circuit Court in and for Jefferson County Florida, and the state of Florida shall be the forum for any and all litigation that may arise from any sale of goods by the seller.
